CONDITIONS OF USE OF THE SKI PASS ACCEPTED IN THE PURCHASE OF THE SKI PASS OR SERVICES AND THE REGISTRATION IN SIERRA NEVADA CLUB

Information

1.The user declares to have read and accepted these general conditions prior to the acquisition of the ski pass or ticket, assuming all that this entails.

2.The ski pass and the ticket are transport passes that entitle the holder to the use of the facilities open to the public at the time, calendar and conditions established for the practice of defined activities.

3.To access any ski lift on any date it is essential to be the holder and holder of a valid ski pass or ticket for that lift and that date.

4.The expected start and end dates of the season, as well as the opening and closing times of the lifts, will be established according to the weather, operational, commercial conditions of the station and/or force majeure.

5.La validity of the ski pass or ticket will be determined by the date of use of this for the current season and / or by the particular conditions when applicable.

6.The rates applied by Cetursa Sierra Nevada, S.A. may be fixed or dynamic and may vary. These rates will be those published in the different sales channels, where the prices of the products per day for each type of ski pass and category will be reflected. 7.Cetursa Sierra Nevada, S.A. may establish specific particular conditions for each type of ski pass or ticket, as well as for those acquired in any of its commercial campaigns. These particular conditions will prevail over the general ones. Each service provider and each promotion has its own cancellation and/or modification policy, which is detailed in the description of the services at the time of purchase.

8.The price of the ski pass and the ticket includes Compulsory Travelers Insurance (S.O.V) and I.V.A. and is detailed in the published rates and in the conditions when applicable. The ski pass or ticket with the best rate price, includes S.O.V. and Management Expenses (G.G) The rates category Benjamín, senior plus, disabled children and those others that CETURSA can commercially establish, must pay € 9 / day or € 70 / Long Term Ski Pass in concept of S.O.V and G.G. 9. 13.La assistance of people and transfer on tracks open to the public within the managed domain is a courtesy service provided by Cetursa Sierra Nevada, S.A. for those customers who have a valid ski pass. 14.In the event of a contradiction between the information on the track report, that provided by any other means and the signalling on the track, the information on the track shall prevail.

Sale

15.Cetursa Sierra Nevada, S.A. may sell ski pass or ticket with conditions of access to the lift different from that of the rest of the passes (for example, Fast-Pass or Disabled, with or without a companion of the person or group, according to the particular conditions that are established). The accesses for these ski passes or tickets will be duly signposted and the rest of the users of the station will not be able to use them.

16.The ski pass can be purchased through the following channels:

a. Face-to-face Sales:
i. At the windows of the Cetursa User Service Center (CAU), in the Sierra Nevada Ski, Snowboard and Mountain Station, if the sale is enabled in it, the company reserves to enable this option or not.
ii. Ski pass vending ATMs may purchase:
- 1/2 day, 1 day and consecutive days (Only categories Children and Adults), as well as pedestrian ticket
- Long-term products and all those that require the validation of documents, whose sale will be managed exclusively online and prior to the arrival of the customer at least 36 hours before, are excluded from the face-to-face sale at the window.

d. In travel agencies. Customers who have purchased their ski passes at travel agencies must present the QR code (agency voucher) at the ski pass vending ATMs.

Pass

17.Cetursa Sierra Nevada S.A reserves the right to carry out the internal controls they deem appropriate (including the capture of personal images, recordings, etc.) and may require the presentation of official documentation that verifies the identity of the owner of the ski pass, the category, promotion or achievement in order to avoid fraudulent use of the ski pass and guarantee compliance with the conditions accepted by the client.

18.La acquisition of a ski pass or a service, the use of the facilities or the membership of the Sierra Nevada Club, indistinctly imply the knowledge and acceptance of these Conditions of Use of the Ski Pass, of the Particular Conditions when applicable, the Rules of Use of the Installations of Mechanical Lifts approved by resolution of 17/12/84 of the General Directorate of Transport of the Junta de Andalucía (BOJA nº 120 of 29/12/84), the ATUDEM Regulations and the International Ski Federation (FIS) Rules, without reservation.

19.Si during the operation of the Station, for safety reasons or other justified reasons, the Management of this is forced to close to public facilities and tracks due to technical, meteorological or any other causes, this does not necessarily require the refund of the amount of the ski pass, compensation or compensation. Sierra Nevada Club Ski Pass Card

23.Sierra Nevada Card is owned by Cetursa Sierra Nevada S.A. and is issued in the name of the holders of the same, being the personalized support of the ski pass or other services with a certain validity, and must be guarded by its holder.

24.Minors may be holders of the Sierra Nevada Club Card and have a profile managed by another adult (user or not), exclusively under the responsibility of their legal guardian.

25.The ski passes of 5, 10, 15, 20 days, Season, Family Season and Season from Monday to Friday, will be purchased exclusively in the https://sierranevada.es trade center for holders of the Sierra Nevada Club card.

26. Sierra Nevada Club Card (physical or virtual) is voluntary and the request and use of this implies knowledge and acceptance of the conditions of use of the ski pass, the conditions of use of the Sierra Nevada Club Card and the particular conditions when applicable. The owner or administrator of the user profile must provide sufficient personal data and supporting documents, committing to the veracity of these.

27. Registration for the Sierra Nevada Club Card requires linking to an email address, from which all communications with the company must be made. Minors will be linked to the email of the adult/guardian/guardian who requests it on their behalf.

Returns

29.The customer may request a refund for non-use of the services through the web or any of its subdomains where the purchase was managed. Offers and promotions are excluded.

30.A single access to the ski lift involves the use of the ski pass and prevents exchange or return.

31.The Long Term and Season Ski Passes in any of their modalities are exempt from any change or total or partial refund.

32.The unused days of the Long Duration ski passes of the current season may be accumulated for the following season when performing
A new purchase of a product of equal or greater duration.

32.The amount corresponding to the number of unused days of a ski pass of 1 to 7 consecutive days may be paid for the amount corresponding to the arithmetic average of the number of days purchased and not taken:

to. Those customers who have made the purchase on their Sierra Nevada Card may request the corresponding refund to the "purse" by requesting through the profile of their user account. This procedure involves management fees of € 9 per ski pass and unused day.
b. For those customers who have made the purchase at ski pass vending ATMs or at the Customer Service Center, they may request the return in the following ways:
i. By presenting themselves at the Customer Service Center with the FF support and the purchase receipt, they may request the corresponding return. This procedure involves management fees of € 10 per ski pass and unused day. The refund will be made through the same means of payment by which you made the purchase.
ii. Requesting the return to the "wallet" by filling in the basic profile of the sierranevada.es trading center. The refund will involve management fees of € 9 per ski pass and unused day. This procedure must be managed entirely by the user.

34. In the case of ski passes purchased through a travel agency, the client must request, if applicable, the corresponding refund from his agency. To do this, you must present to the agency the purchase receipt issued at the User Service Center or at the ski pass vending ATMs of the Sierra Nevada ski resort at the time of withdrawal of the ski pass. The agency will be the one who proceeds to the corresponding return, once it is confirmed by Cetursa Sierra Nevada, S.A the non-use of said ski pass.

35. In case of non-opening of the station, the customer who purchases his ski pass in the Customer Service Center, ATMs selling passes, or as a holder of the Sierra Nevada Club Card, may opt for the refund in his wallet or through the same means of payment by which he made the purchase from the last day of validity of his pass.

36.Except in the cases detailed in the previous points, in general they will not be entitled to any refund, total or partial refund, compensation or compensation:

b. Offer and/or promotion pass with restricted particular conditions.

37.La deadline to submit any application for membership in general will be before May 15 of the current season in the user profile in case of being holders of the Sierra Nevada Club Card, or in sierranevada.es/cliente in case of having acquired your FF by any other means. Requests for returns will not be attended once this date has passed.

Infringements

38.The ski pass or ticket acquired and activated in any medium is personal and non-transferable and enables the use of the ski lift facilities exclusively to a single person holder and carrier during the entire period of validity. The fraudulent use, the use by another person other than the owner, or the use of a ski pass or ticket of a category or type of amount lower in price than the one that corresponds to it, as well as the falsity of the documentation presented will entail the withdrawal, cancellation and electronic cancellation of the ski pass or ticket and the cancellation of the rights and services acquired, not proceeding right to return or compensation, being communicated the fact to the competent authority. Additionally, the sanctions indicated in the following section will be imposed.

39.PENALTIES: The use of Ski Pass, ticket or pass of category lower than that corresponding to the user, or that has been previously used by a person other than the current holder, will be sanctioned in the following terms:

I. With the withdrawal, cancellation and electronic deactivation of the title or titles recharged in the ski pass, ticket or pass.
ii. with the withdrawal, where appropriate, of Sierra Nevada Club and the cancellation of the rights and services acquired:
1. The user may reacquire ownership of Sierra Nevada Club, paying the following penalty: amount of 100 euros for each day of infringement.
2. It will be penalized with the loss of the promotion or discount in the current season and three subsequent seasons.

These penalties may be applied retroactively if the undertaking detects, through its own verification systems, the fraud committed.

40.Cetursa Sierra Nevada S.A. reserves the right to expel from the facilities and ski lifts, to withdraw the ski pass or ticket, to cancel the Sierra Nevada Club Card, to cancel all rights to the products or services purchased, without prejudice to the
civil or criminal responsibilities in which additionally could be incurred, in case of inappropriate or dangerous behavior, breach of the instructions given by its staff, insult or aggression of any kind to other users or workers and, in general, for breach of the rules of use of the facilities or use of the ski pass or Sierra Nevada Club Card, for which it empowers its staff.

Legislation

41.The user of the ski lifts authorizes Cetursa Sierra Nevada S.A. for the processing and storage of personal data, the use of the ski pass and the ski lifts or visual or telephone recordings that will be included in an automated file of Cetursa Sierra Nevada, S.A. for the purpose of developing the contractual relationship and sending commercial offers. The owner of a ski pass in Sierra Nevada may access, rectify, cancel and, where appropriate, oppose the processing of their personal data by writing to Customer Service, Edf. 42.Es the power of the user to cancel a contract in certain cases without having to justify their decision or assume any penalty. In accordance with article 93 k) of Royal Legislative Decree 1/2007 approving the Consolidated Text of the General Law for the Defense of Consumers and Users and other complementary laws, it is not applicable to passenger transport service contracts. Therefore, in the reservations of passenger transport services, the right of withdrawal does not apply. In this way, in the event that the user expresses his willingness to cancel the tickets / SUBSCRIPTIONS contracted, the cancellation conditions of the transport operating company in question will apply.

43.According to Article 103a. Exceptions to the right of withdrawal, of Royal Legislative Decree 1/2007 approving the Revised Text of the General Law for the Defense of Consumers and Users and other complementary laws. The provision of services, once the service has been fully executed, when the execution has begun, with the prior express consent of the consumer and user and with the recognition on his part that he is aware that, once the contract has been completely executed by the entrepreneur, he will have lost his right of withdrawal.
